Terms of Service

Who we are

The service is provided by Daniele Stumpo, Ekenknick 7, 22523 Hamburg, Deutschland (email support@getconvivio.com). It is designed mainly for private individuals organizing parties and events; companies and associations can use it too. Consumer protection rules, including the right of withdrawal, apply only to purchases made as a consumer.

The service

Convivio lets you create event pages with a personalized invitation, collection of guests' replies, a private photo gallery plus a public one via QR code, an audio/video guestbook and management tools. Some features depend on the chosen package.

Account

Organizing events requires an account with truthful information. You are responsible for safeguarding your credentials and for what happens through your account. Guests do not need an account.

Packages and prices

• Packages (guests, gallery storage) are one-time purchases per event: no subscription, no automatic renewal.
• Each Gallery package states how many months we keep photos and videos (currently 6 months on entry packages, 12 on higher ones). The countdown starts on the gallery activation date, which you choose and we suggest a month before the party: buying early uses up no retention time. Once the gallery is open, the date can no longer be moved.
• When you move to a higher package you only pay the difference from the one already bought for the same event.
• Displayed prices are final prices. Pursuant to § 19 UStG (German small-business scheme, Kleinunternehmerregelung), no VAT is charged or shown.
• Every new event starts with a fully functional 7-day free trial, no credit card required. If it is not activated by purchasing a package before the trial ends, the event is paused: the data is kept, but the public pages stay unreachable until it is activated.

How the contract is concluded

• The presentation of packages on the website is not a binding offer. You choose the package on your event's “Package” page, see the price to pay, confirm the required checkboxes and are then taken to Stripe's secure payment page.
• The contract is concluded when you complete the payment by pressing the payment button on that page. Right after, the package is activated and you receive a purchase confirmation by email; the invoice arrives in a separate email.
• Until the last step you can correct your choices or cancel by going back or closing the payment page: nothing is charged in that case.
• The contract can be concluded in English, German or Italian. These terms are always available on this page; your purchase details remain in the confirmation email and the invoice.

Content duration and deletion

When the package expires, gallery and guestbook content remains recoverable for 30 days and is then permanently and automatically deleted. We remind you by email before expiry and recommend downloading your photos (a full-download button is available). Permanent deletion is not reversible.

Organizer responsibilities and content

• You warrant that you have the right to use the content you upload and to invite the people whose data you enter.
• For your guests' data you decide what is collected (see the privacy policy): informing them and collecting any required consents (particularly for minors) is up to you.
• You are responsible for moderating your gallery: you have tools to hide and delete guest-uploaded content.

Acceptable use

Uploading illegal or defamatory content, content violating others' rights or dignity, and using the service for spam or abuse is forbidden. In case of violations we may remove content and suspend or close the account; we will tell you why, unless legally prevented.

Reporting illegal content

Anyone can report content they consider illegal by writing to support@getconvivio.com: please include the link of the gallery or page, which content, why you consider it illegal, and your name and email (except for reports of child sexual abuse, which can also be sent anonymously). We review reports promptly and objectively and let you know our decision. This address is also the point of contact under Articles 11 and 12 of Regulation (EU) 2022/2065 (Digital Services Act), in English, German or Italian.

Content ownership

Content remains the property of whoever uploaded it. You grant us only the technical license needed to host it, process it (e.g. previews, metadata stripping) and show it to the people the organizer gives access to.

Availability

We do our best to keep the service available, but interruptions for maintenance, updates or failures of external providers beyond our control can happen. Convivio is not a backup service: for important memories, download and keep a copy of your own too.

Liability

• We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.
• For slight negligence we are liable only for breach of an essential contractual obligation — one whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely; in that case liability is limited to the foreseeable damage typical for this kind of contract.
• Otherwise liability for slight negligence is excluded. These limitations also apply in favour of our vicarious agents.

Right of withdrawal (for consumers)

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day the contract is concluded. To exercise it, you must inform us (Daniele Stumpo, Ekenknick 7, 22523 Hamburg, Deutschland, support@getconvivio.com) of your decision by an unequivocal statement, for example an email. You may use the model withdrawal form below, but it is not obligatory. To meet the deadline, it is sufficient to send your communication before the withdrawal period has expired.

Effects of withdrawal: we will reimburse all payments received from you without undue delay and in any event within 14 days from the day we are informed of your decision, using the same means of payment you used, at no cost to you.

Immediate start: packages are activated right after payment. Before every payment we ask you to confirm with a checkbox that you request the immediate start and acknowledge that you lose your right of withdrawal once the contract has been fully performed; we repeat this in the purchase confirmation email. If you withdraw within the 14 days after requesting the immediate start, we refund the price paid minus an amount proportionate to the part of the service already provided up to the moment you tell us you are withdrawing.

Model withdrawal form (complete and return it only if you wish to withdraw): “To: Daniele Stumpo, Ekenknick 7, 22523 Hamburg, Deutschland, support@getconvivio.com. — I/We (*) hereby give notice that I/we (*) withdraw from my/our (*) contract for the provision of the following service: … — Ordered on (*)/received on (*): … — Name of consumer(s): … — Address of consumer(s): … — Date: … (*) Delete as appropriate.”

Changes to these terms

We may update these terms, for example when we add features or laws change. New versions apply to new purchases; for packages already purchased, the terms accepted at the time of purchase remain valid, except for changes required by law or solely to your advantage. For changes affecting the account we will notify you by email at least 30 days in advance: if you disagree, you can close your account at any time.

Governing law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer habitually resident in another EU country, the mandatory consumer protection rules of that country remain unaffected. For business customers the place of jurisdiction is Hamburg, Germany; for consumers the statutory jurisdictions apply.

We are not obliged, nor willing, to participate in dispute resolution proceedings before a consumer arbitration board.
